TERMS AND CONDITIONS OF SALE

In the context of distance selling (without the simultaneous physical presence of the parties), in accordance with the Commercial Practices Act of 6 April 2010, the consumer has the right to inform the seller that he is canceling the purchase, without payment of a fine and without giving a reason within 14 calendar days from the day following the delivery.

II. Scope of application

The current general terms and conditions of sale apply to all orders placed on greenhouse.boutique, greenhousestore.be and greenhouseshop.be. Consequently, any person who orders a product offered for sale at Greenhouse fully accepts these terms and conditions and acknowledges that the Customer has been aware of this before his / her order.

 

Greenhouse reserves the right to change the general terms and conditions of sale at any time. The General Terms and Conditions of Sale that apply are those terms and conditions that are accepted by the customer at the time of placing his / her order.

III. Quotations and acceptance of the order

IV. Delivery

Greenhouse sells from Belgium and delivers to various EU countries. Incorrectly transmitted or non-existent delivery addresses are the responsibility of the Buyer and may give rise to additional costs. For delivery in a specific country that is not included in the destinations, the Customer can contact Greenhouse to obtain more information about the delivery conditions in that specific country. The delivery times stated on the Greenhouse website are not binding, but are merely given as an indication.

 

Orders placed at Greenhouse are handled as soon as payment for the order has been received. The delivery of products is foreseen within 3 to 10 days after payment. For some products the delivery time will be longer than 10 days, this will also be stated online with the product specifications and in the order confirmation. Products with a longer delivery time are made at the request of the Customer and cannot be canceled. No delay in delivery can give cause for cancellation of the purchase or payment of damages for the benefit of the Buyer, except in the case of deliberate delay.

 

Greenhouse cannot be held responsible in the event of force majeure, which would affect the production, availability, transport or delivery of the product. If incorrect prices are stated on greenhouse.boutique, greenhousestore.be or greenhouseshop.be due to technical errors and on the basis of these incorrect prices a purchase contract is established, Greenhouse has the right to cancel the purchase contract, even after the order has been sent by e -mail is confirmed. The payment will be reimbursed immediately.

 

In the event of non-delivery of the goods, any amounts paid by the Buyer will be reimbursed without interest or other compensation. Greenhouse has the right to make partial deliveries. In the event that an order consists of several products of which certain products are immediately available and others not immediately, Greenhouse will only deliver the order if all products of the order are available. In the event that the Customer wishes to receive the available products earlier, he must enter a separate order for these products and pay the transport costs twice.

 

An email is automatically sent to the Customer at the time of sending the goods, and this to the email address that was entered at registration. Transport costs are confirmed at checkout, before the final confirmation of the order. Transport costs depend on the destination, weight and dimensions. V. Pricing

All other costs that are inherent to placing an order, such as internet connection or communication costs, are for the account of the customer.

VI. Payment

The customer can pay for his order online with VISA, MasterCard, Maestro or IDEAL. The Client guarantees Greenhouse that he has the required license to use the chosen method of payment. The debit for purchases on account of the customer is made at the time of processing the order.

 

Payment of an order is done online and can be done with a debit or a credit card, and this always for the entire order. Online payment is done in a very secure way, namely via "SSL payment". This is an Ogone security program that has been approved by the Central Service for Information System Security and that strictly complies with banking regulations. Ogone's encryption process ensures complete confidentiality of the information provided by the customer. An order is only considered valid once payment has been accepted by the chosen payment system (Visa, Mastercard, Maestro, Ideal). The data from the payment system is proof of all transactions.

VII. Orders and contractual obligations

The order can be placed both online and in the store. The personal data and information provided by the customer when ordering must be correct and complete. Every order falls under the present general terms and conditions and becomes contractual as soon as the confirmation email has been sent. VIII. Transfer of Property

Greenhouse remains the owner of the delivered products until full payment has been made by the customer. However, the above provisions do not prevent the transfer to the Customer of the risks of loss or damage to the products during delivery, as well as of the damage that they could cause.

The transfer of ownership of the ordered product will take place as soon as the order has been placed, that is as soon as the confirmation of the order has been sent, and this after acceptance of the payment.

IX. Renunciation right

In the context of distance selling (without the simultaneous physical presence of the parties), according to the law of 6 April 2010, the law of commercial practices, the customer has the right to return his order, without paying a fine , with the exception of the costs of shipping and returning the goods, and this within a period of 14 days, starting from the day of receipt of the goods by the Customer.

 

The customer must inform Greenhouse of this by registered letter with acknowledgment of receipt, addressed to: Greenhouse, Ooststraat 3, 8630 Veurne, Belgium or by contacting Greenhouse via (e-mail) hello@greenhouse.boutique stating the order number and the reason for the return. Greenhouse will then indicate to the customer the steps to be followed. In all cases, the return is carried out at the risk of the customer. The customer must be able to provide proof of return at all times.

 

The products that are returned must be intact, in a perfect condition for resale (not used), and in the original packaging. They must not have been worn or used and show no signs of wear or deterioration. The goods must always be in a state of perfect purity. Any product that is damaged, incomplete, or whose original packaging has deteriorated, will neither be refunded nor exchanged. This right to return is exercised without penalty, with the exception of the transport costs that are still for the customer.

 

In the event that the right to return is exercised by the Customer, Greenhouse will, upon receipt, send an email to the Customer with acknowledgment of receipt. Greenhouse will then award the Client credits for the same amount.

 

The customer can also ask for a full refund of the sum. In this case, please send an email to hello@greenhouse.boutique. In the case of a request for reimbursement, Greenhouse will refund the amount within 30 days.

 

All products on the site can be returned unless explicitly stated. In any case, the right to return will not apply to products that have a personal character, that were made according to the specifications of the Customer or that are only made to order. The delivery time of these products is often longer than 4 weeks. For example, articles ordered in a different color, specific size or composition on the website. Even products that must be assembled by the buyer can no longer be returned after ordering. The Customer can only cancel these goods within 14 days of purchase. Products that age too quickly or whose quality deteriorates cannot be returned. Also, any services that have been performed cannot be canceled.

X. Complaints

Greenhouse reminds the customer that it is the responsibility of the customer to inspect the shipment upon receipt and in the presence of the representative of the shipping service and to point out to the shipping service as well as Greenhouse the presence of any anomaly (blows, damage to the packaging, …) And this within 2 working days after the delivery of the goods. In the absence of any notification of this, the product is considered accepted by the Customer and this anomaly can no longer be the subject of any dispute regarding the delivery. Complaints related to the state of delivery are not accepted a posteriori by Greenhouse.

XI. Guarantee

In accordance with the Civil Code, the current provisions cannot relieve the professional seller of the guarantee against all consequences of hidden defects in the goods sold. The customer is explicitly informed that Greenhouse is not the producer of the goods that are offered in the store (s) of Greenhouse via the online store.

 

As a result, in the event of damage caused to a person or property due to a defect in the product sold, only the manufacturer of this product will be held responsible by the Customer based on the information stated on the packaging of the aforementioned product is becoming.

XII. Force majeure

Neither party is considered to have failed in their contractual obligations to the extent that their performance is delayed, blocked or prevented by circumstances beyond their control. Greenhouse complies with current Belgian legislation on privacy and data protection. Visitors to the website always have the right to access, adapt, correct and delete data related to them.

 

At the time of registration or order, or in the context of other specific promotions, Greenhouse will invite visitors or Customers to receive newsletters, promotional offers or offer to register in order to remain informed of its exclusive sales.

Such a resulting change does not entitle the Client to disregard general terms and conditions of sale. If a sales condition is not explicitly stated, it will be considered as a condition that is generally applicable in the mail order sales sector in Belgium.

XVI. Applicable law

All agreements between Greenhouse and the Customer are subject to the case law of the Belgian Law. Only the Belgian courts are considered authorized. Only Belgian law is applicable in the event of litigation and if no amicable settlement agreement can be reached. Only the Court of Ghent is authorized independently of the place of delivery and / of place of residence of the Customer.
